I think this French case is a month or so old but the bit about US life insurance policies is new to me too. But it makes sense that they’re doing this because disqualifying claims is what the insurance business is all about; promise everything and deliver nothing –the perfect equation for making money in the insurance industry.
What I doubt is that the judge can justify the claim that the victim knew that death was a possibility. Where has death ever been mentioned on the form people sign before getting injected? Or was death a commonly known side effect in the media? It may be an experimental treatment but it was never revealed to the victims that it was gambling with their life or even their health. The victims are all victims of fraud, I’d say.
