The problem is that the court created a pathway to prosecute a president for unofficial acts. Why do I think that is exactly what the Dems will do, and in a hurry? Of course President Trump will be able to go after Obama and Biden in the same fashion. That would be fun!
Maybe down the road this drives real power back to the States, if presidents are more handcuffed.
I wonder if SCOTUS is thinking that far ahead … Thomas and Gorsuch for sure … did they slip this in?
