“Did you, in this litigation, challenge the appointment of special counsel?” Thomas asked Trump attorney John Sauer on Thursday during a nearly three-hour session at the Supreme Court.
Sauer told Thomas that, “we totally agree with the analysis provided by Attorney General Meese [III] and Attorney General Mukasey.”
“It points to a very important issue here because one of [the special counsel’s] arguments is, of course, that we should have this presumption of regularity. That runs into the reality that we have here an extraordinary prosecutorial power being exercised by someone who was never nominated by the president or confirmed by the Senate at any time. So we agree with that position. We hadn’t raised it yet in this case when this case went up on appeal,” Sauer said.
Clarence Thomas is, to my mind, the conscience of the constitution in this court. He has more of the ordinary man about him than any other member, and that allows him to cling closely to the original intent of the constitution, which was written to protect and defend the ordinary man! Long live Clarence Thomas!

(cynical me says Trump’s legal teams want to drag out the drama as long as possible so he can play the victim as well as for fundraising and media attention.)
I was surprised when I read this yesterday. It was as if Thomas was sending a message that the defence was missing THE most basic fundamental defense issue.
Am sure these lawyers are paid big $$$$ to NOT miss defense points.
You could be on to something — there is almost ZERO focus on policy as every news coverage is about how corrupt Trump is OR how he is a martyr OR how the justice system has become weaponized agains’t citizens (ie: “criminals allowed to roam free” to “innocents being politically persecuted J6” etc etc).
If it’s a deliberate election strategy, it’s working quite well!
