Well, the lawyers in DC certainly want this decision reversed. They would have a field day if agency regulations can be adjudicated.
Sounds like “reasonable interpretation” would have to become better defined under any updated Doctrine. Good luck with that. Where does the Paperwork Reduction Act come into play? How about the (Unwritten) Law of Unintended Consequences?
Anything that restricts the Administrative State from acting unilaterally is a great thing
IMHO…They are after all…The DEEP STATE that we all complain about
The courts are in on it too.
The only answer is to put Congress and its law making in reverse.
Not just a balanced budget Amendment, but a fixed cap on the CFR (the size of the regulatory code).
Ie, get out the chain saws.
We get one shot at stripping the deep state of its assumed authority. One. Hope the court gets a few brain transplants before rendering a decision
