Brunson SCOTUS case: a big fat nothingburger
For anyone following the Brunson petition to the Supreme Court, this will be of interest to you. According to Robert Barnes, my favorite commentator on all things legal, the Brunson lawsuit is “…a big fat nothingburger”. I wish Barnes had shared his opinion a month ago — better late than never!!
Outside of fringe circles the case wasn’t well known a month ago.
Now the question is, does Barnes’ opinion matter?
Its a fair assessment, sure.
Could so easily be a bridge too far.
Think of the death threats they would get if they ever ruled for plaintiffs on this.
If they rule against them (and setting a precedent) does this end all hope for The Constitution as it was meant to be?
Barnes is great and very confident BUT fallible like all of us
He was really SURE of a Red Wave too.

I won’t bet on it, but I’d like nothing better than to see Barnes proven wrong in this case. My guess is if that happened, he would not only be shocked but also happy.
