An Alberta judge made a landmark decision yesterday, ruling that the province’s Chief Medical Officer of Health Deena Hinshaw’s order placing gathering limits on demonstrations against COVID-19 restrictions did not apply to protesters. Provincial Court Judge Michael Dinkel acquitted a Calgary freedom rally organizer charged under a public health order for attending a protest while the restrictions were in place in December 2020. At the heart of the issue was Alberta Health Service’s insistence that freedom rallies were “private gatherings” and subject to their rule. However, Judge Dinkel disagreed with this assessment and acquitted the accused because, in his view, freedom rallies were public demonstrations. This is a massive win against the selective enforcement against pro-freedom protests and for our Charter-enshrined right to gather. This decision could potentially set a precedent that may nullify similar cases currently making their way through the courts. Calgary’s anti-protest injunction was rescinded back in March. We also saw the criminal charges against Pastor Tim Stephens dropped earlier this month after a year of legal wrangling following his arrest for opening his church in defiance of the province’s COVID-19 gathering limits. But although the news is encouraging, we can’t rest on our laurels as numerous legal battles stemming from these public health orders continue, including the charges faced by Pastor Artur Pawlowski. Pastor Artur was recently released after 51 days behind bars and still has the legal fight of a lifetime ahead of him from charges related to keeping his church open, feeding the homeless, and speaking at an anti-mandate protest.
