Amazing. I never even thought about that. City councils overruling provincial and Federal health dictats. Will wonders never cease! Normally the laws of the higher level government take precedence over lower levels however in this case I don’t think there are actual Federal or Provincial mask lows. So city councils are free to write the law themselves. It will be up to the higher levels of government to respond with legislative action if they are unhappy. Or maybe just ignore Vancouver. Or even back down.
I live in a small community in British Columbia. These are the establishments I visit regularly: the grocery, the pharmacy, the hardware, the liquor outlet,
the petrol stations, the antique shop. The staff do not wear masks, nor do the customers for the most part. Occasionally an elderly customer will appear in a mask. Its optional – except at the hospital, in clinics, and the like.
Also I have hosted family (children, grandchildren, etc.) and friends from across the province and beyond. We are careful, but not fearful.
The lockdown, when it happened earlier this year, was “please stay home, don’t go out if you are ill.” It was never “you are required to stay home.”
We do our bit to keep each other safe, but we were never forced to cower at home.
The economy needs to breath, or it will die.
We are not children. For those of whose lives are unnecessarily restricted due to Covid – stand firm for your rights!
I don’t live in BC but I do know that they declared a state of emergency in regards to Corona. They then used to power to limit travel in and out of the province as just one example. In theory that declaration also gave the provincial government special powers that did not need to be voted on or vetted in the legislature.
Ontario also declared a state of emergency back in March as did Alberta while Quebec declared a “health emergency” (which is slightly different and less far reaching). Of course all of it flowed from the World Health Organizations declaration of what they termed a “Global Public Health Emergency”.
But notably, not all provinces and regions made similar declarations nor did Trudeau place the country under a national state of emergency which in the old days was called the War Measures Act. So basically all the noise and smoke has been coming from the jurisdictions that did make declarations and where cities could fine and jail people for breaking the new laws.
The media amplified these events to a level that left the impression the entire country was similarly under repressive lockdown orders when in fact most of us have simply been cooperating voluntarily. There was little to no enforcement anywhere and most provincial premiers just talked their citizens into going along with the program.
This is important. Because when the people volunteer to cooperate they cannot turn around later and sue anybody or make a claim they were forced into lockdowns. Down in the US there were also a large number of States like South Dakota that did not take any action at all with regards to the Covid emergency. But those states like New York and California that did create law were given headline billing in the media night after night. We were left believing the world was about to end even though the largest numbers of deaths and infections were conveniently in the States that had harsh lockdowns.
Needless to say, a great many people have been misled. Most of us in both the States and Canada remain free to do whatever in hell we please. That includes keeping business open, travelling and shopping or even not wearing masks if we so choose. So the curious thing about this panic (and it is a classic panic in every sense of the word) is that most of the pressure is coming from the media itself and then the citizen repeaters who try to enforce these ideas on everyone else.
Social pressure in other words, not law, is keeping most of us confined. It is simply amazing.
Anyway, my whole point in the above post (sorry it was so long) is that we need to individually know our rights on a city by city and province by province basis. The CBC is not telling us our rights nor is CTV. They are so busy telling us covid statistics and pandering fear that cherished civil rights have been mostly forgotten. Just ask yourself one of these simple questions:
Is there a law on the books prohibiting the (specify an activity) in my jurisdiction?
Is there a low enforcing the use of face mask in my city/ my province?
Is there a law that does not allow freedom of association such as Sunday Church or normal socialization?
If there is not a law then you are still living under the Canadian Charter of Rights and may not be under any emergency order at all. Secondly, the emergency orders in the provinces that have enactd them are time limited. You need to know when the state of emergency expires. These are not open ended but rather, have fixed ending dates.
