In a groundbreaking decision filed today, NY State (NYS) Supreme Court Judge Gerard Neri held that the COVID-19 vaccine mandate for healthcare workers is now “null, void, and of no effect.” The court held that the NYS Dept. of Health lacked the authority to impose such a mandate as this power is reserved to the state legislature. Furthermore, the court found that the mandate was “arbitrary and capricious” as COVID-19 vaccines do not stop transmission, vitiating any rational basis for a mandate.

Took way too long coming but better late than never.
There should have been an injunction filed against the mandates, PENDING this very decision.
All the top NYS Dept of Health officials involved in this decision should be forced to resign immediately, given what this meant for workers (and public perceptions). And probably folks further up the line also. RDS would not have stood for this in FL, so the buck doesn’t stop at DoH.
IMO, justice delayed is not justice served. So the courts need to render decisions that compensate for lost justice. They must IMPEDE faulty decision making by placing higher costs on those that screw up, if that’s how its later ruled. In a nutshell, there’s INSUFFICIENT ACCOUNTABILITY throughout Government, everywhere.

The NY state Covid vaccine mandate for health care workers was just one layer that was eradicated.
You still have the US federal Covid vaccine mandate for health care workers for all hospitals and health care institutions that work with Medicare and Medicaid. This is the big albatross around the neck of the health care system. This needs to be eliminated but I hear no press whatsoever on getting rid of it. Being in healthcare myself it’s prevented me from reentering the field. I’m aware there is an “underground railroad” of smaller facilities that offer exemptions to employees.
The federal vaccine mandate for healthcare workers has to go!
