SWEDEN – At 16 she was raped. A court just ruled it didn’t last long enough.
In a decision that has sparked widespread outrage, Sweden’s Court of Appeal for Upper Norrland has ruled that Yazied Hamed Mohamed, an 18-year-old refugee, will not be deported despite his conviction for raping a 16-year-old girl, Meya Åberg. The court determined that the assault, while serious, did not qualify as “exceptionally serious” under Swedish law, partly due to its relatively short duration.

In 2024 Åberg was walking home after missing her bus following a shift at a local McDonald’s. According to court documents, Mohamed intercepted her, forcibly took her phone, dragged her into the tunnel, and ?’ed her. Åberg, who was 16 at the time, immediately reported the attack to authorities with her family’s help.
Mohamed, a citizen of Eritrea with refugee status in Sweden, was initially acquitted by a lower court due to insufficient evidence linking him to the crime. However, the appeals court overturned that ruling in September convicting him. He was sentenced to three years in prison.
Prosecutors had sought deportation, arguing that the crime warranted expulsion. But the court rejected this, stating that refugees can only be deported for “particularly serious” offenses or if they pose a significant threat to public order. In its judgment, the court noted: “Taking into account the nature and duration of the act in question, the Court of Appeal finds that the crime is indeed serious, but that there was no question of such an extremely serious crime that could lead to a decision on the expulsion of Yazied Mohamed.” The ruling classified the ? as one of “normal degree,” not severe enough to override Mohamed’s protections under the 1951 UN Refugee Convention.
