Poland’s Constitutional Tribunal president, VP to be disciplined by ‘court’
Unfortunately, the events in Poland since Friday show that Donald Tusk’s government has stopped respecting the law altogether.
Executive summary
-
On November 3, 2026, eight people, five of whom never took the oath of office before the President of the Republic, met at a “General Assembly of Judges of the Constitutional Tribunal” convened by Anna Korwin-Piotrowska. As we pointed out on Monday, a meeting convened by an unauthorized person and in breach of procedure could not produce any legal effects.
-
Just as we predicted, the “General Assembly” failed to reach a quorum. Those present “calculated” it on the basis of twelve judges, leaving out the President, the Vice-President and one other judge, although the statute requires two-thirds of the total number of judges of the Tribunal – a number the Constitution sets at fifteen.
-
Any disciplinary action against the President of the Constitutional Tribunal and his deputy is null and void. Not only were the disciplinary benches drawn unlawfully, but in both of them a majority are unauthorized persons. Moreover, the charges themselves are unfounded, as in essence they concern lawful conduct.
