USA – Federal Judge strikes down Biden Vaccine Mandate for healthcare workers…
U.S. District Judge Matthew Schelp, who was appointed by President Trump, issued the preliminary injunction for employees at Medicare and Medicare-certified medical facilities in North and South Dakota, Nebraska, Wyoming, New Hampshire, Missouri, Kansas, Iowa, Alaska, and Arkansas.
“Under the Biden administration’s mandate, healthcare workers who work at hospitals, nursing homes, and other healthcare facilities that receive federal funding have been ordered to get vaccinated against COVID by January 4, receive a medical or religious exemption, or face firing.
Schelp in his 32-page opinion decided that the detrimental impact of losing qualified healthcare workers outweighs the need for employees to be vaccinated and said the mandate imposes a burden “on the ability of healthcare facilities to provide proper care, and thus, save lives.”
“The scale falls clearly in favor of healthcare facilities operating with some unvaccinated employees, staff, trainees, students, volunteers, and contractors, rather than the swift, irremediable impact of requiring healthcare facilities to choose between two undesirable choices — providing substandard care or providing no healthcare at all,” he wrote.”
Correct decision but for the wrong reason. His decision is technically correct and appropriate for the facts and specific industry and reason of need to provide qualified healthcare. The problem is it leaves open a wide hole for most industries that aren’t as critical or necessary. Instead of arguing these cases on the basis of how critical a particular industry is, the argument needs to be about the Constitutional right(bill of rights) of every citizen to pursue life, liberty and the pursuit of happiness. What is more fundamental than the right of each citizen to make one’s own healthcare decisions and to not lose their ability to earn a living based on those decisions? We need a court case that goes to the Supremes where they uphold that basic right. There are no “exemptions” to the Constitution, not for health or any other phony, trumped up reason.
While I agree with you there is now 2 decisions regarding federal mandates. I expect more hopefully striking down mandates and thus doing away with them permanently.
However, hospital facilities can still mandate the vaxx if they want to do that. In my neck of the woods I know of peeps getting exemptions in the private hospital world, but outwardly being strict regarding the mandates. What a show….
